General terms and conditions

§ 1 Scope and contracting party

(1) These general terms and conditions apply to all contracts concluded via our online shop at roughcountry.de. Rights that are expressly granted to consumers below apply only to consumers within the meaning of Section 13 of the German Civil Code (BGB).

(2) Your contracting party is Goeren Truck Shop e. K., owner Yasar Gören, Hamburger Str. 3, 21339 Lüneburg, Germany, phone +49 4131 242526, email vertrieb@truckshop.de, registered in the commercial register of the Amtsgericht (Local Court) Lüneburg under HRA 1763.

§ 2 Conclusion of the contract

(1) The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.

(2) You place products in the shopping cart, enter your billing and delivery address during checkout (with a customer account or as a guest) and choose the shipping and payment method. Before you submit the order, all details are shown on an order overview page. There you can check your entries and correct them using the options offered or the back function of your browser. By clicking the button to place the order with obligation to pay, you submit a binding offer to purchase the goods in the shopping cart.

(3) Immediately after submitting the order, you receive an automatic email confirming receipt of your order (order receipt confirmation). This email does not yet constitute acceptance of your offer.

(4) The contract is concluded as follows:

• for payment via PayPal, as soon as you complete the payment with PayPal during checkout;
• for payment in advance (bank transfer), as soon as we declare acceptance of your order by email – at the latest with our email confirming receipt of your payment – or dispatch the goods to you, whichever occurs first.

(5) If a PayPal payment is cancelled or fails, no contract is concluded as a result. You can retry the payment via the link in the order receipt confirmation or choose another payment method offered.

(6) The contract can be concluded in German or English.

(7) We store the contract text (your order data). You receive the order data, these general terms and conditions and the cancellation policy with the order receipt confirmation by email. If you have a customer account, you can also view your orders in your account. You can access and print the current general terms and conditions on this page at any time.

§ 3 Prices and shipping costs

(1) All prices are final prices in euros including statutory VAT.

(2) Shipping costs are charged in addition to the prices. The amounts are stated on the Shipping and payment page and are shown in the shopping cart and on the order overview before you submit the order.

(3) Online orders are possible for delivery addresses in Germany and in the other member states of the European Union. Shipping costs are shown in the shopping cart and on the order overview before you submit the order. To the other member states of the European Union we deliver freight goods; the freight cost is calculated for the delivery address and shown before you submit the order. Individual parcel items are shipped there on request. We do not offer deliveries to countries outside the European Union.

§ 4 Payment

(1) You can pay via PayPal or in advance by bank transfer.

(2) Payment via PayPal is processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. PayPal's terms of use apply. The amount is charged when you complete the payment during checkout.

(3) For payment in advance, you receive our bank details with the order receipt confirmation. Please transfer the invoice amount within 14 days, stating your order number. We dispatch the goods once payment has been received.

§ 5 Delivery and availability

(1) We deliver to the delivery address you specify. Depending on the item, goods are shipped as a parcel or by freight forwarder.

(2) The expected delivery time is stated on the respective product page. For payment in advance, the delivery time begins on the day after you instruct your bank to make the transfer; for payment via PayPal, it begins on the day after the contract is concluded.

(3) If an ordered item is not available, we will inform you without undue delay. We will refund any payments already made for items that cannot be delivered without undue delay. Your statutory rights remain unaffected.

§ 6 Retention of title

The goods remain our property until paid in full.

§ 7 Liability for defects

(1) The statutory warranty rights for defects apply.

(2) If goods are delivered with obvious transport damage, please report such damage to the delivery agent as soon as possible and inform us. Failure to do so has no consequences whatsoever for your statutory claims.

§ 8 Liability

(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have assumed.

(2) In the event of a slightly negligent breach of an obligation whose fulfilment is essential for the proper performance of the contract and on whose compliance you may regularly rely, our liability is limited to the foreseeable damage typical for the contract. Otherwise, we are not liable for slight negligence.

(3) The above provisions do not apply to claims under the statutory liability for defects; these remain unaffected.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. Details and the model withdrawal form can be found in our cancellation policy. You can also declare the withdrawal online via “Withdraw from contract”.

§ 10 Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
